Terms of Service

Participant Agreement & Liability Waiver

Please read these Terms of Service (“Agreement”) carefully before enrolling in the Personal Safety Mentorship provided by The Other Way Martial Consulting (“Company,” “we,” “us”). By paying your deposit and enrolling in the program, you (“Student,” “Participant”) agree to be bound by these terms.

1. Nature of Services

The Other Way provides a hybrid educational program consisting of virtual consulting, strategic planning, and physical martial arts instruction (Kyo-Jitsu Ryu). The goal of this training is to enhance personal safety, situational awareness, and physical capability.

Disclaimer: While this training is designed to increase your safety, no system can guarantee safety in every situation. The Student acknowledges that personal safety is ultimately their own responsibility.

2. Medical & Physical Liability Waiver

The “Live Deployment” weekend and weekly “Lab Work” involve physical activity, including but not limited to: striking, blocking, movement drills, and partner work.

  • Assumption of Risk: You understand that physical training involves an inherent risk of injury, including bruises, strains, or other physical harm. You voluntarily assume these risks.
  • Medical Fitness: You confirm that you are physically capable of participating in this training and have no medical conditions that would make participation dangerous to yourself or others.
  • Release of Liability: You agree to release, indemnify, and hold harmless The Other Way Martial Consulting, Sensei B. Duncan, and any host facilities from any claims resulting from injury or damage sustained during training.

3. Scope of Practice (Not Therapy)

This mentorship often addresses topics related to trauma, fear, and psychological control. However, The Other Way is not a licensed mental health provider.

Our services are strictly educational and strategic in nature (coaching/consulting). They are not a substitute for professional therapy, counseling, or psychiatric care. If you are in a mental health crisis, please contact a licensed professional immediately.

4. Payment & Refund Policy

We commit significant time and resources to each student, including venue rentals and travel logistics for the Live Deployment. Therefore, our financial policies are strict but transparent.

  • Holding Fee ($50): This fee is strictly non-refundable. It secures your priority spot on the waitlist and is fully credited toward your total tuition. The company matches this fee dollar-for-dollar as a donation to our scholarship fund immediately upon receipt.
  • Tuition Balance ($947): The remaining balance is invoiced prior to the start of the virtual semester. You may choose to pay in full (receiving a $50 discount) or in three monthly installments.
  • Refund Eligibility:
    • Before Virtual Start: If you withdraw before the virtual sessions commence, any tuition balance paid is fully refundable (excluding the $50 holding fee).
    • After Virtual Start: Once the virtual sessions commence, all tuition payments are non-refundable. You immediately gain access to proprietary content and small-group instructor time which cannot be recouped.
  • Live Event Attendance: The Live Deployment dates are published well in advance (First or Second weekend of the designated month). We do not offer refunds or make-up dates if you cannot attend the live training due to personal scheduling conflicts. Attendance is mandatory for certification.
  • Instructor Cancellation: In the unlikely event that The Other Way must cancel a training cycle (e.g., medical emergency, act of nature), students will be offered a full refund (including the holding fee) or a priority seat in the next cycle.

5. Code of Conduct

Safety requires trust. We reserve the right to remove any student from the program without refund if they exhibit:

  • Unsafe physical behavior or lack of control during drills.
  • Harassment, bullying, or abusive behavior toward the instructor or fellow students.
  • Intoxication during any training session (Virtual or Physical).

6. Intellectual Property

The Kyo-Jitsu Ryu curriculum, materials, and specific methodologies taught in this mentorship are the intellectual property of The Other Way. You are granted a license for personal use only. You may not reproduce, resell, or teach this material commercially without explicit written certification from Sensei B. Duncan.
